General Rental Terms and Conditions

Application
These general rental terms and conditions apply to reservations and agreements regarding the recreational apartments 'Suvelfabryk' located at Moasterwei 14, 9134 PD Ljussens.
The term "tenant" refers to the person who enters into a rental agreement with Suvelfabryk regarding the rental of the recreational apartments.
These terms and conditions apply regardless of your (prior) reference to any terms and conditions of your own or any other terms and conditions. We reject all general terms and conditions to which you refer or which are used by you.
Deviations from these conditions are only valid if agreed upon in writing.
Article 1 - Reservations
Reservations are only possible for persons aged 18 or older.
After reservation, the tenant will receive a confirmation, the general terms and conditions, and an invoice within five days.
Check the reservation confirmation for accuracy. Errors must be reported immediately.
The agreement is final upon receipt of the reservation confirmation.
Article 2 - Payment
Payment is subject to the following conditions:
Payments must be made via iDeal or Credit Card.
35% of the rental sum must be paid within 14 days of the invoice date.
The remaining amount (65%) must be paid no later than one month before arrival.
In case of late payment, we reserve the right to cancel the reservation.

Article 4 - Changes
If, after the conclusion of the booking/contract, the tenant wishes to make changes to the booking, we are not obliged to comply with them. It is at our discretion whether and to what extent changes are accepted. In principle, changes within 4 weeks prior to arrival cannot be permitted.
Wenn der Mieter nach Vertragsabschluss den Aufenthaltszeitraum in einen anderen als den reservierten Zeitraum ändern möchte, gelten die Stornierungsbedingungen gemäß Artikel 5. Ein anderer Aufenthaltszeitraum umfasst in jedem Fall einen Zeitraum, der nicht innerhalb des vom Mieter reservierten (und vom Vermieter bestätigten) Zeitraums liegt.
Article 5 - Cancellation
Cancellation by the tenant must always be made in writing (by mail or e-mail). The following conditions apply:
Partial payments will not be returned upon cancellation.
For cancellation up to 42 days before the day of arrival, 35% of the rent is due.
If cancelled up to 28 days before the day of arrival, 50% of the rent is due.
In case of cancellation from seven days to the day of arrival, 100% of the rent is due.
Wenn Sie nicht innerhalb von 24 Stunden nach dem vereinbarten Termin ohne weitere Benachrichtigung ankommen, wird dies als Stornierung betrachtet und 100% des Mietpreises werden fällig.
In case of cancellation on our part, any monies already paid will be refunded.
Article 6 - Receipt of key
The tenant will receive, one week before arrival by mail the key procedure.
Any costs incurred due to your failure to return the property on time will be recovered from you. Goods found after your departure will be kept for you for a reasonable period of time, but we take no responsibility for them. Returning items can only be done at your expense.
Article 7 - Staying in the vacation home
Reservations/stays are subject to the following periods and times of stay, namely:
Weekend: Friday from 3:30 p.m. to Monday 10 a.m.
Midweek: Monday from 3:30 p.m. to Friday 10 a.m.
Week: Friday from 3:30 p.m. to Friday 10 a.m.
The tenant and other users must conduct themselves as good tenants during their stay in and around the recreation apartments.
On the day of arrival you can use the apartment from 3:30 pm onwards. On the day of departure the apartment must be vacated by 10:00 am.
The apartments are non-smoking. Smoking is allowed outside on the terrace .
No open fire may be used outside, except in the fire pits provided for that purpose.
Pets are allowed in apartments 5,6,7 and 8; only in the living room and kitchen. Pets are not allowed on the furniture. For dogs/cats, protection against fleas is mandatory.
The rent includes final cleaning and rental of bedding and linen.
Subletting or reletting is expressly prohibited.
The stay of more persons in the vacation apartments than agreed upon (at the time of booking) or than the maximum applicable for the apartments is expressly not allowed without our permission, unless otherwise agreed upon in writing. Parties are also prohibited. This may lead to premature termination of the rental agreement on our part, without refund of the rent.
Moving closets and beds, as well as sound equipment or taking any part of the (indoor) inventory outside is expressly not allowed, with the exception of the dishes/glasses and cutlery for your meal outside.Â
The tenant must ensure that between 11 p.m. and 7 a.m., sleep is respected. This includes no loud music/noise. Tenant shall ensure that there is no nuisance to the natural environment or nearby residents.
We reserve the right to charge an additional deposit in certain situations and periods. On this basis, we are entitled to charge each group (or family) a deposit of up to € 500.00 per person.
Article 8 - Force majeure
Force majeure on our part exists if the performance of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond our control including war risk, personnel strikes, blockades, fire, floods and other disturbances or events.
Article 9 - Liability/complaints/damages. Â
The tenant and other users in the rental period in question are fully and severally liable for all damage caused to the house, inventory and all items belonging to the rented object, unless the tenant and other users can make it plausible that the damage can not be attributed to them. We therefore recommend that upon arrival at vacation home you inspect the inventory carefully for defects and numbers. If you notice any damage or defects, please report it to us immediately.
We accept no liability for theft, loss or damage of or to property or persons of any kind during or as a result of the stay in the vacation rental.
We accept no liability for construction activities on the (main) roads etc. in the vicinity of the Suvelfabryk. We accept no liability in the event of failure or inoperability of technical equipment, utilities, the non-functioning or partial non-functioning of the Internet.
The cost of normal maintenance and repair of defects shall be borne by us. If defects occur, the tenant should notify us immediately and follow our instruction as much as possible.
Should you still wish to make a complaint, it must be submitted to us in writing, stating reasons, within 14 days of leaving the vacation home.  Â
Article 10 - Departure and final cleaning
Additional (cleaning) costs may be charged to the tenant in case of improper use or improper abandonment of the vacation home;
After the end of the period of stay, the tenant must at departure:
Leaving the house (broom) clean and tidy           Â
All washed clean, dried off and placed back in the cabinet;
Beds should be collected and comforter covers and linens should be placed at the door of the apartment entrance;
To leave the dishwasher and refrigerator clean and empty;
Bringing food and not leaving it in the cupboard(s) and/or refrigerator/freezer;
Garbage garbage cans to have been emptied. In the apartment there is a bin for residual waste. Outside at the entrance to the shared outdoor area are four bins for a. green waste, b. glass, c. residual waste and d. paper.
Report any breakage and/or damage to Jellie Dam, "controller of everything.
Article 11 - Applicable law
All our terms and conditions and provisions of the rental agreement/house rules as well as any disputes arising therefrom are governed exclusively by Dutch law.
